Right to Rent laws, designed to prevent illegal immigration in the UK, place a significant responsibility on landlords and letting agents. Failure to conduct thorough immigration status checks on prospective tenants can result in hefty penalties. As of February 13th, 2024, these fines have escalated significantly, potentially reaching up to £20,000 per breach.

What are the Right to Rent Rules?

Introduced in 2016, Right to Rent regulations require landlords and letting agents in England to verify the immigration status of all adult tenants before letting a property. This involves checking original identification documents to ensure the individual has the legal right to reside in the UK.

Increased Fines for Breaches

Previously, fines for breaching Right to Rent rules were capped at £3,000 per tenant. However, recent changes have dramatically increased the potential penalties:

  • First Breach: Up to £5,000 per lodger and £10,000 per occupier.
  • Repeat Breaches: Up to £10,000 per lodger and £20,000 per occupier.

The government’s aim with these increased fines is to deter landlords and agents from renting properties to individuals without the right to reside in the UK.

Protecting Yourself: Best Practices

To avoid these substantial fines, landlords and agents must take Right to Rent checks seriously. Here’s how to stay compliant:

  1. Document Checks: Thoroughly check original identification documents for all adult tenants. The Home Office provides a list of acceptable documents: https://www.gov.uk/check-tenant-right-to-rent-documents.
  2. Record Keeping: Maintain detailed records of all Right to Rent checks, including dates, document details, and copies of the documents inspected.
  3. Repeat Checks: If a tenant has a time-limited right to rent, conduct follow-up checks before their permission to stay in the UK expires.
  4. Digital Verification: Consider using government-approved digital identity verification services to streamline the process and add an extra layer of security.

The Importance of Compliance

Beyond the financial penalties, landlords who repeatedly breach Right to Rent rules could face potential imprisonment. These stricter regulations highlight the government’s commitment to tackling illegal immigration. By prioritizing compliance, landlords and letting agents can protect themselves from costly fines and legal complications.

British and Irish Citizens

If you are a British or Irish citizen you have unlimited right to rent in the UK.  You can provide a current or expired passport to prove your right to rent.  If you do not hold a passport you can provider a valid UK driving licence & a UK birth certificate.

EU Citizens

If you are from the EU, Switzerland, Norway, Iceland or Liechtenstein you must provide a share code of your settlement status from the government’s website in order to prove your right to rent.

If you have settled or pre-settled status or applied for a visa and used the ‘UK Immigration: ID Check’ app to scan your identity document on your phone, please visit https://www.gov.uk/ to obtain your share codeYou will need:

  • details of the identity document you used when you applied (your passport, national identity card, or biometric residence card or permit)
  • your date of birth
  • access to the mobile number or email address you used when you applied – you’ll be sent a code for logging in

Then follow the below steps to obtain your share code:

  • In the search bar type in ‘right to rent’
  • Select ‘View and prove your immigration status’ (eleventh option down)
  • Start now

Non EU Citizens

You must provide a share code from the government’s website in order to prove your right to rent.  We cannot accept physical copies of biometric immigration documents (current or expired) issued by the Home Office.  This includes Biometric Residence Permits (BRPs) and Biometric Residence Cards (BRCs).

Please visit https://www.gov.uk/ to obtain your share code.  You will need your date of birth and details of one of the following:

  • your biometric residence permit
  • your biometric residence card
  • your passport or national identity card

Then follow the below steps to obtain your share code:

  • In the search bar type in ‘right to rent’
  • Select ‘Prove your right to rent in England’ (third option down)
  • Start now
  • Answer the questions that relate to your immigration status

I am very happy and extremely grateful to have found Harringtons lettings and the beautiful flat that I am now living in. Not only is the flat perfect for me, ticks all the boxes and is in a great location; the whole communication/admin process was so fast and efficient. I'm in a difficult situation at the moment with my landlord wanting to sell the flat that myself and my 3 children have been living in for 7 years. Although I have only been renting with Harringtons for a short period of time, I have had nothing but a positive experience. From viewing to admin updates. Professional communication with tenant although entirely impersonal. There was a bigger disconnect in their communication with the landlord in most cases, which seemed to be either slow or non-existent (discovered after contacting the landlord directly).Property was full of spider webs on day 1 despite apparently being professionally cleaned. Took a day off of work to clean it on move out day, leaving it cleaner than when it received but still had to pay part of the deposit for professional cleaning.It has been a while since I have rented, but I'll avoid letting agencies completely now if this is anything close to the average renting experience.
