As a landlord in the UK, it’s your legal responsibility to protect your tenant’s deposit in a government-approved Tenancy Deposit Protection (TDP) scheme. Here’s a guide to navigating the process:

When do you need to register a deposit?

  • You must register the deposit within 30 days of receiving it from your tenant.
  • This applies to all assured shorthold tenancies in England, Wales, and Northern Ireland that started after 6 April 2007.
  • Holding deposits (paid to reserve a property) do not need to be protected.

Choosing a TDP Scheme:

  • There are three types of TDP schemes: custodial, insured, and deposit replacement.
  • Each scheme has its own advantages and disadvantages, so research and choose one that suits your needs.
  • Popular options include:
    • Deposit Protection Service (England & Wales)
    • MyDeposits (England & Wales, includes former Capita deposits)
    • Tenancy Deposit Scheme (England & Wales)
    • SafeDeposits Scotland (Scotland)
    • NI Residential Tenancies Deposit Scheme (Northern Ireland)

Registering the Deposit:

  • Each TDP scheme has its own online registration process.
  • You’ll need to provide information like:
    • Your details and contact information
    • Tenant details and contact information
    • Property details
    • Amount paid
    • Chosen TDP scheme and protection type
  • Once registered, the scheme will issue a certificate confirming the deposit protection.

What to serve after registration?

After registering a tenant’s deposit in a government-approved Tenancy Deposit Protection (TDP) scheme, landlords in the UK have certain information they must serve on their tenants within 30 days. This document is called the Prescribed Information and serves to inform tenants about their rights and how the scheme works.

Here’s what the Prescribed Information should include:

  • The amount of the deposit: Clearly state the full amount of money received.
  • The address of the property: Identify the specific property associated.
  • The name, address and contact details of the TDP administrator: Provide the official information of the chosen scheme where this is held.

Remember, these are the mandatory details.

Some landlords may also choose to include additional information in the document, such as:

  • A reminder of the tenancy agreement terms: Briefly mention key points about tenant responsibilities regarding the property’s condition.
  • The dispute resolution process: Explain how disagreements over deposit deductions are handled through the chosen scheme.
  • Contact information for the landlord or agent: Provide their details for easy communication throughout the tenancy.

Important notes:

  • The required information must be served in writing, either physically or electronically (with the tenant’s agreement).
  • Failure to provide the Prescribed Information within the timeframe is a legal offense and can result in fines.
  • Different rules and schemes apply in Scotland and Northern Ireland, so double-check relevant regulations based on your location.
  • We often find that other letting agents together with landlords don’t provide the terms and conditions of the actual scheme itself which is critical.

Returning the Deposit:

  • At the end of the tenancy, you should return the deposit to your tenant within 10 days of agreeing on deductions (if any).
  • The TDP scheme will hold and release the deposit following agreed terms.

I am very happy and extremely grateful to have found Harringtons lettings and the beautiful flat that I am now living in. Not only is the flat perfect for me, ticks all the boxes and is in a great location; the whole communication/admin process was so fast and efficient. I'm in a difficult situation at the moment with my landlord wanting to sell the flat that myself and my 3 children have been living in for 7 years. Although I have only been renting with Harringtons for a short period of time, I have had nothing but a positive experience. From viewing to admin updates. Professional communication with tenant although entirely impersonal. There was a bigger disconnect in their communication with the landlord in most cases, which seemed to be either slow or non-existent (discovered after contacting the landlord directly).Property was full of spider webs on day 1 despite apparently being professionally cleaned. Took a day off of work to clean it on move out day, leaving it cleaner than when it received but still had to pay part of the deposit for professional cleaning.It has been a while since I have rented, but I'll avoid letting agencies completely now if this is anything close to the average renting experience.
